Prior to August 1, 2001, service was furnished under MCI WORLDCOM Communications Tariff FCC No. 10 filed with the Federal Communications Commission and now canceled. Beginning August 1, 2001, service is being furnished pursuant to this Guide and any underlying written contract between the Company and the Customer.
Please note the following regarding this important change.
· MCI WORLDCOM Communications Tariff FCC No. 10 was amended on June 23, 2001 to incorporate new or revised General Definitions and new or revised General Terms and Conditions of Service contained in WorldCom Tariff FCC No. 1. Like the service in former MCI WORLDCOM Communications Tariff FCC No. 10, these General Definitions and General Terms and Conditions are now part of this Guide and, therefore, are part of customer service contracts. Some of the definitions and terms and conditions contained in former MCI WORLDCOM Communications Tariff FCC No. 10 are reflected in the General Definitions and General Terms and Conditions of Service and, accordingly, were removed from the former tariff at the time of detariffing on July 31, 2001. This explains why there may be omissions or gaps in the service information previously found in MCI WORLDCOM Communications Tariff FCC. No. 10 and currently contained in this Guide.
· Except as noted in the preceding paragraph, the text of this Guide replicates the information contained in former MCI WORLDCOM Communications Tariff FCC No. 10 on July 31, 2001.
· If there is an inconsistency between a General Definition or a General Term and Condition, a service-specific definition or term and condition, or a definition and term and condition contained in a written contract between the Company and the Customer, the relationship with the Customer will consist of the following, in order of precedence from (1) through (3): (1) the definition or term and condition in the written contract; (2) the service-specific definition or term and condition; and (3) the General Definition or Term and Condition. An inconsistency will be deemed to include any instance in which a service-specific definition or a service-specific term and condition has no counterpart in the General Definitions or the General Terms and Conditions of Service.
· The Company may change the Guide from time to time and any change made will be binding on customers after fulfillment of the notice period set forth in Section 7.B of the General Terms and Conditions.
· Any reference to tariff within the text of the Guide shall mean Guide.
GRANDFATHERED SERVICES
APPLICABILITY
The rates, terms and conditions set forth in this tariff apply only to Message Telecommunications Services ordered pursuant to agreements entered into prior to December 31, 1997, and are subject to other conditions of availability as set forth herein. The use of such Service is subject to the jurisdiction of the Federal Communications Commission. Upon expiration of the Service Commitment Period with respect to Service provided by Company under this tariff, such Message Telecommunications Services shall be provided pursuant to MCI WORLDCOM Communications, Inc. Tariff F.C.C. No. 6 (formerly, WorldCom Technologies, Inc. Tariff F.C.C. No. 2) and WorldCom Technologies, Inc. Tariff F.C.C. No. 1, or any successor tariff.
EFFECTIVE JUNE 23, 2001, THE RULES AND REGULATIONS CONTAINED IN THIS TARIFF ARE SUPERSEDED BY THE GENERAL DEFINITIONS AND GENERAL TERMS AND CONDITIONS CONTAINED IN WORLDCOM TARIFF F.C.C. NO. 1, EXCEPT AS OTHERWISE PROVIDED FOR IN SECTION 1.C.01 THEREOF.
1.1 DIAL UP-WATS
A) Description
This service arrangement allows a customer to originate calls in areas with Equal Access capabilities served by the Company by presubscribing to the service, or by a non-travel authorization code which in limited instances is provided to customers who are not served by an Equal Access office. Calls can be terminated at any point in the United States, Puerto Rico and the U.S. Virgin Islands. International Service is available to presubscribed customers at the rates appearing in WorldCom Technologies, Inc. Tariff F.C.C. No. 1, Section 4.3.2.
The applicable usage rate depends upon the distance between originating and terminating points and the rate period(s) in which the call occurs. Calls are billed in six second increments. Discounts are given based upon the customer's usage volume and the applicability of any optional billing plan discounts. A monthly service charge applies to each customer account.
A customer who fails to pay any charges owed to the Company as prescribed in the Rules and Regulations Section of the tariff will be terminated as a DIAL-UP WATS customer. Additionally, the customer will not be eligible for any volume discounts.
B) Monthly Service Charge
A monthly service charge of $5 applies to each account when total usage is $50 or less during a billing period. This charge will not apply to the first and last month's invoices when service is provided for a partial billing period.

1.2 DEDICATED WATS SERVICE
A) Description
This service arrangement allows a customer to originate calls via dedicated access facilities connected to Company locations, and terminate calls via switched access facilities at any point within the United States, Puerto Rico and the U.S. Virgin Islands. International Service is available at rates appearing in WorldCom Technologies, Inc. Tariff F.C.C. No. 1, Section 4.3.3.
The applicable usage rates depend upon the type of access facilities utilized (analog vs. digital), the distance between originating and terminating points and the rate period(s) in which the call occurs. Calls are billed in increments of six (6) seconds after an initial minimum billable period of six seconds. A minimum average time requirement (MATR) call duration of thirty (30) seconds applies to a customer's monthly domestic calls. Discounts are given based upon the customer's usage volume and the applicability of any optional billing plan discounts.
B) Usage Charges
The following rates apply to calls terminated at points in the United States, Puerto Rico and the U.S. Virgin Islands.

(c) Minimum Average Time Requirement
If an account's total domestic usage divided by the number of domestic calls is less than thirty (30) seconds, the customer's usage charges will be determined by multiplying the number of calls by thirty (30) seconds to arrive at billable usage, and multiplying that usage amount by the average billable rate for the calls made during that period to determine total usage charges.

C) Service Charges - Service charges apply whenever a customer initiates a service order request. The application of these charges is described below.
Administrative Change Charge - This is a $50 one-time order processing charge which applies whenever a customer initiates a request for a service record change, or for changes, additions or deletions regarding access lines or optional features. It includes all customer initiated orders that are not considered Billing Changes or involve the establishment of a billing account.
Billing Change Charge - This is a $20.00 one-time order processing charge which applies whenever a customer requests that a change be made in the billing records (i.e. billing address) or bill format (i.e. paper, microfiche, magnetic tape, number of copies, special reports.).
Order Expedite Charge - This is a $105.00 one-time charge whenever a customer places an order for the installation, move or rearrangement of a local distribution channel and has designated a service date which is sooner than the standard interval for the order processing, engineering review, access order coordination and installation functions. When, upon initial review, the Company determines that it can accommodate such a request, that service request will be designated as an expedited order. The acceptance of an expedited order by the Company in no way assures or guarantees that the requested service activity will be accomplished by the designated service date.
The Company will process expedited orders in a timely fashion to endeavor to meet the designated service date. In instances when it is determined that an expedite order must be sent to a Local Exchange Carrier (LEC) providing access facilities to improve upon their standard installation interval, a separate charge will apply to recover the amount of the additional LEC charges.
In the event that the LEC is unable to improve upon its installation interval such that the Company is unable to install service by the designated service date, the order expedite charge will still apply in full.
D) Optional Features and Billing Arrangements - Dedicated WATS customers may utilize the following optional features and billing arrangements: Project Accounting Codes, Verified Accounting Codes, Abbreviated Dialing, NPA Screening, "1+" Screening, Prefix NPA, Advanced Call Manager, Ultimate Call Manager and the Fixed Period Discount Plan.
1.3 NEW PRECISION SERVICE
A) Description
This service arrangement allows a customer to originate calls in areas with Equal Access capabilities served by the Company by presubscribing to the service, or by a non-travel authorization code which in limited instances is provided to customers who are not served by an Equal Access Office. Calls can be terminated at any point in the United States, Puerto Rico and the U.S. Virgin Islands. The applicable usage rates depend upon 1) the state in which the call originates, 2) whether the call terminates at a Metrosaver or a Non-Metrosaver point (see Section (B) following), and 3) the customer's calling volume. Calls are billed in six second increments. Additional discounts are available through optional billing arrangements.
Customers who have not established an account with the Company but utilize the network through casual access by dialing a 5-digit code will not be eligible for New Precision Service rates.

C) Usage Charges

1.3 PRECISION PLUS SERVICE
A) Description
This service arrangement allows a single location customer to originate long distance calls in areas served by the Company. Access to Precision Plus is obtained by presubscribing the customer's telephone to the Company, or by utilizing a non-travel authorization code which in limited instances is provided to customers who are not in Equal Access areas. Calls can be terminated at any point in the United States, Puerto Rico and the U.S. Virgin Islands. International Services is available to presubscribed customers at rates appearing in the Company's F.C.C. Tariff No. 1, Section 4.3.2.
The applicable usage rates depend upon the state in which the call originates. Calls are billed in six (6) second increments. Precision Plus has no monthly fee or minimum usage requirement. A discounted rate applies to all customers located in the area codes specified in Section (B) following. Precision Plus customers may not subscribe to the Company's Advanced or Ultimate Call Manager billing programs, may not participate in a Fixed Period discount plan and may not be an toll-free or WATS service customer.

1.5 HOME PLUS
A) Description
The Home Plus option is an outward calling shared access arrangement available to customers who presubscribe to the Company's service. Calls are billed in one minute increments subject to a sixty minute per month minimum applicable to off-peak interstate minutes of use. Usage rates are time-of-day sensitive.

1.6 MFS INTELENET MESSAGE TELECOMMUNICATION SERVICE
A) Description
Domestic Interstate Message Telecommunications Service (MTS) is a communications service which is available for use by customers twenty-four (24) hours a day. Customers may originate MTS from locations served by the Company, and may terminate in all locations within the United States. Operator, MFS Intelenet Calling Card, and Directory Assistance services are available to Customers of the Company's MTS service subject to the provisions of the Company FCC Tariff Nos. 1 and 2.
Business MTS calls will be billed in 6 second increments with an initial billing period of 18 seconds.
Residential MTS Calls will be billed in 1 minute increments with an initial billing period of 1 minute. In addition, Residential MTS calls are eligible for volume discounts based on total cross-contribution usage from all interstate and intrastate shared and dedicated outbound and inbound usage products (directory assistance and operator assist are also contributory). Charges such as taxes, late payment fees or other service non-recurring and monthly recurring charges will not be included in the volume discount cross-contribution calculation.
The service is offered in two variations depending upon the method the Customer employs to gain access to the Company's network for use of the service:
(1) PIC'd MTS is offered in Feature Group D (FGD) exchanges whereby the Customer's local telephone lines are presubscribed by the local exchange company (LEC) to the Company's MTS service, such that "1+" interLATA calls are automatically routed to the Company's network.
(2) Dedicated (Standard Subscriber or Digital T-1) MTS is offered to the extent facilities are available in those cases where the Company and the Customer jointly arrange for the establishment of dedicated access facilities connecting the Customer's trunk-compatible PBX or other suitable equipment to the Company's POP. The Customer shall be responsible for all costs and charges associated with the dedicated access facilities.

E) New International Message Telecommunications Service
(1) Descriptions of Service
New International Message Telecommunications Service (NIMTS) consists of the furnishing of switched international message telephone service between the Company's operating centers in the United States and the international locations identified in this Section. Such service is available twenty‑four (24) hours a day, seven (7) days a week. NIMTS will be billed in six (6) second increments with an initial billing minimum of thirty (30) seconds. Service to Canada and Mexico will be billed in one (1) minute increments with an initial one (1) minute billing period.
(NIMTS) Customers will be charged for calls based on the foreign destination. Unless otherwise specified, the location of the Company's operating center does not affect the charge for the call.
(2) Explanation of Rates for New International Message Telecommunications Service
The rates for the Company's New International Message Telecommunications Service will depend upon the length of the call, the time period in which the call is placed, and the international location to which the call terminates. All calls will originate from the exchange closest to the calling party's physical location. Calls which overlap rate periods will be charged according to the rates applicable to the time recorded in each period.

1.7 OPTION 6 - DIAL 1 ACCESS
A) Description
Dial 1 Access is an outward calling switched access service. Usage is flat-rated and time-of-day sensitive. Dial 1 Access calls are billed in 6 second increments, with an initial billing period of 18 seconds per call. Dial 1 Access is only offered to non-OCS Customers.
Dial 1 Access is offered in Feature Group D exchanges whereby the Customer's local telephone lines are presubscribed by the local exchange company to the Company's long distance service such that "1+ the 10-digit number" interLATA calls are automatically routed to the Company's network. Calls to stations within the Customer's LATA may be placed by dialing "10+XXX" or "101+XXXX" + 1 + the 10-digit telephone number.

In any month in which customers usage charges, including usage charges and plan fees, are less than $9.99, Customer will be billed the difference between the usage charges and the minimum monthly charge so that Customers monthly charges equal a minimum of $9.99.
2.1 MFS TOLL-FREE SERVICE
A) Description
Toll Free Service is an inbound communications service which permits calls to be completed at the Customer's location without charge to the calling party. Access to the service is gained by dialing a ten (10) digit telephone number (eg. 800+ NXX-XXXX) which will terminate at the Customer's location. Calls may originate from any location within the United States and may terminate at the Customer's location.
Usage discounts apply to aggregate monthly interstate and intrastate usage. MFS Intelenet Toll Free Service will be billed per call based on the duration of the call. Each call will be billed in 6 second increments with an initial billing period of 30 seconds.
Toll Free Service is offered in two variations depending upon the method the Customer employs to access the Company's network for use of the service:
PIC'ed toll free service calls are originated via normal shared use facilities and are terminated via the Customer's LEC-provided local exchange service access line.
Dedicated (Standard Subscriber and Digital T-1) toll free service calls are originated via normal shared use facilities and are terminated via dedicated access facilities connecting the Customer's premises and the Company's POP. This service is offered to the extent facilities are available and where the Company and the Customer jointly arrange for the establishment of dedicated access facilities connecting the Customer's trunk-compatible PBX or other suitable equipment to the Company's POP. The Customer shall be responsible for all costs and charges associated with the dedicated access facilities.

2.2 OPTION 1 - TOLL-FREE SERVICE
A) Description
This service permits calls to be terminated to a customer's location from any point in the contiguous United States, Alaska, Hawaii, Puerto Rico and the U.S. Virgin Islands. The Toll-Free Service customer rather than the calling party is billed for the service. Calls are billed in increments of six seconds and subject to a minimum average time requirement of thirty seconds per billing period. This service may also be billed under the product name Performance Toll-Free.
Toll-Free Dedicated Termination Service permits calls to be terminated to a customer's location over dedicated access arrangements originating from Company locations. Usage charges depend upon the distance between the originating and terminating points of a call and rate period(s) in which a call occurs. Volume discounts apply based on a customer's applicable usage charges for a billing period. Additional activation and monthly charges also apply as well as access arrangement charges. Voice grade equivalent access lines are subject to minimum usage requirements.
Toll-Free Shared Termination Service permits calls to be terminated to a customer's location via the Company's equal access facilities. Usage charges depend upon the distance between the originating and terminating points of a call and rate period(s) in which a call occurs. Volume discounts apply based on a customer's applicable usage charges for a billing period. Additional activation and monthly charges also apply.
Prelude Toll-Free Service permits calls to be terminated to a customer's location via the Company's equal access facilities. Usage is billed at a single per minute rate. Volume discounts do not apply. A Toll-Free Service number activation and recurring charge applies to each number provisioned. Optional features and service arrangements are not available with this service.
B) Toll-Free Service Number Charge
(1) There is a non-recurring activation and monthly charge associated with the establishment and maintenance of a customer's toll-free routing information in the Company's network. The charges apply to each toll-free number provisioned.

Discounts will be applied to a customer's usage charges based upon the customer's total interstate and intrastate Toll-Free Service usage charges for an account for the billing period. (4) Minimum Usage Requirement
There is a minimum average usage requirement of $125.00 per activated voice grade equivalent line in a customer's dedicated access line group. If actual usage does not meet or exceed the minimum usage amount, this minimum amount will be billed in lieu of the actual usage charges.
2.3 Canadian Toll Free Service
A) Description of Service
Canadian Toll Free Service is an inbound communications service which permits calls to be completed at the Customer's location without charge to the calling party. Access to the service is gained by dialing a ten (10) digit telephone number (eg. 800+ NXX-XXXX) which will terminate at the Customer's location. Calls may originate from any location within Canada and may terminate at the Customer's location within the United States.
Usage discounts apply to aggregate monthly interstate and intrastate usage. Canadian Toll Free Service will be billed per call based on the duration of the call. Each call will be billed in 6 second increments with an initial billing period of 30 seconds.
Canadian Toll Free Service is offered in two variations depending upon the method the Customer employs to access the Company's network for use of the service:
PIC'ed toll free service calls are originated via normal shared use facilities and are terminated via the Customer's LEC-provided local exchange service access line.
Dedicated (Standard Subscriber and Digital T-1) toll free service calls are originated via normal shared use facilities and are terminated via dedicated access facilities connecting the Customer's premises and the Company's POP. This service is offered to the extent facilities are available and where the Company and the Customer jointly arrange for the establishment of dedicated access facilities connecting the Customer's trunk-compatible PBX or other suitable equipment to the Company's POP. The Customer shall be responsible for all costs and charges associated with the dedicated access facilities.

2.4 Homebound 800/888 Service
A) Service Description
Homebound 800/888 is an inbound service available to Company residential Customers only. The Company reserves the right to suspend the provision of this service based on the availability of toll-free numbers. This service enables the Customer to receive "toll-free" 800/888 service calls at their residence. The residential Customer will be assigned a toll-free telephone number to receive calls that are paid for by the Customer rather than the calling party.
B) Usage Charges
Usage Charges are determined by the time of day, rate periods and minutes of use within each rate period.

Effective October 1, 2014, the monthly recurring charge for toll free service will not contribute towards the minimum usage charge for Customers long distance service. The toll free monthly recurring charge, and any other charges related to Customers toll free service, will not contribute towards the minimum usage fee for Customers long distance service.
3.1 MFS OPERATOR SERVICES
Operator Service is available to users of the Company's MTS and Total Solution-LDS services and to users accessing presubscribed public payphones or customer-provided stations for operator-assisted calls. In addition to charges which would otherwise apply pursuant to other Sections of this tariff, each operator call will be assessed a charge(s) as set forth in this section.

Person-to-Person: Calls completed with the assistance of a Company operator to a particular person, station, department, or PBX extension specified by the calling party. Charges may be billed to the Customer's commercial credit card and/or LEC calling card, calling station, called station, or a designated third-party station. Station-to-Station: Refers to calls other than person-to-person calls billed to either the end user's commercial credit card and/or non-proprietary calling card. Calls may be dialed with or without the assistance of a Company operator. Collect calls to coin telephones and transfers of charges to third-party telephones which, are coin telephones will not be accepted.
Operator Dialed Charge: The end user places the call without dialing the destination number, although the capability to do it himself exists. The end user will dial "0" for local calls and "00" for long distance calls and then requests the operator to dial the called station.

3.2 INTERNATIONAL DIRECTORY ASSISTANCE CALLS (DA)
The Company will connect MFS Intelenet New International MTS and International MTS Customers to Directory Assistance (DA) for a fee as set forth in this section. A credit allowance for DA will be provided upon request if the Customer experiences poor transmission quality, is cut-off, receives an incorrect telephone number, or misdials the intended DA number (NPA+ 555-1212).

3.3 BILL-TO-CALLING CARD (BCC) SERVICE
Bill-to-Calling Card Service allows users of touch-tone telephones connected to the Company's MTS and Total Solution-LDS services to charge calls to their local exchange company (LEC) calling card. In addition to standard MTS and Total Solution-LDS rates, the BCC charge, as set forth in this section applies when users complete calls by entering both the called number and their LEC calling card number without the assistance of an operator. The Company accepts only LEC calling cards which it can identify as valid. Charges for BCC calls will appear on the user's LEC bill.

Dial 1 Access is an outward calling switched access service. Usage is flat-rated and time-of-day sensitive. Dial 1 Access calls are billed in 6 second increments, with an initial billing period of 18 seconds per call. Dial 1 Access is only offered to non-OCS Customers.
Dial 1 Access is offered in Feature Group D exchanges whereby the Customer's local telephone lines are presubscribed by the local exchange company to the Company's long distance service such that "1+ the 10-digit number" interLATA calls are automatically routed to the Company's network. Calls to stations within the Customer's LATA may be placed by dialing "10+XXX" or "101+XXXX" + 1 + the 10-digit telephone number.

(1) Description
Area Code Blocking: Blocks inbound calls based upon the originating area codes.
Area Code Routing: Routes calls to the toll free number to multiple answering locations based upon the NPA of the calling party. Up to 4 locations can be specified.
Time of Day/Day of Week Routing: Permits the Customer to have calls to the same toll free telephone number routed to different pre-determined locations based upon the time of day, or day of week of the main answering location. Up to 4 locations can be specified.
Route Advance: Allows calls to a dedicated toll free trunk group to overflow to a pre-determined alternate routing arrangement under conditions of busy, ring no-answer, or network congestion.
Emergency Restoration: Allows a Customer to pre-define alternative routing arrangements that can be activated upon command in the event of a Customer emergency. To activate, the Customer calls a special number and, after proper security precautions, the Customer's traffic is rerouted
DNIS ("Dialed Number Identification Service"): Used in conjunction with dedicated toll free service, where multiple toll free numbers terminate to (or share) the same access facility. The toll free network sends the digits dialed by the calling party ahead of the call. This allows subscriber CPE equipped to "read" DNIS information digits to route the call to the appropriate department or extension.
After Hours Toll Free Message Handling: Utilizing the Company's Voice Messaging facilities, subscriber's toll free calls can be routed based on time of day or day of week to a voice mailbox. After Hours Toll Free Message Handling is available with the following options:
Message Announcement Only - A simple subscriber customized announcement is played to caller without the ability to record a caller's message. The announcement can be tailored for each subscriber.
Announcement with Message Recording In addition to subscriber's customized announcement, the caller is allowed to leave message.
Announcement Message Capability, and Message Notification - System outdials to notify subscriber (or pager) a message has been left.
Toll-Free Number Referral - Subscribers who change an toll free number can route calls to their old toll free number to a Company messaging facility to announce the change in numbers. The message can be customized to fit the subscriber's needs.

4.2 MFS INTELEPLAN SERVICE
A) Description
MFS Inteleplan Service is a communications service that is available for use by residential customers twenty-four (24) hours a day. MFS Inteleplan Service is offered in exchanges whereby the Customer's local telephone lines are presubscribed by the local exchange company (LEC) to the Company's MFS Inteleplan Service, such that "1+ the 10-digit number" calls are automatically routed to the Company's network. Customers may originate MFS Inteleplan Service from locations served by the Company, and may terminate in all locations within the United States.
MFS Inteleplan Service is a flat-rated calling plan that is non-distance sensitive for direct-dialed long distance calling. Charges are based on the time period (Peak/Off-peak) when the call is placed. Calls are billed in one-minute increments, with an initial billing period of one minute. A monthly recurring charge will apply to Customer accounts with usage (including Directory Assistance) of less than $25.00. Customer accounts with usage in excess of $500.00 per month will be assessed a surcharge. The entire month's charges will be recalculated at the new rate level.

(1) ExactCall PLUS - This service option is an outward calling shared access service arrangement available to customers who presubscribe to the Company's service. Usage rates are time-of-day and distance sensitive. Calls are billed in six second increments.
(2) ExactCall WATS - This service option is an outward calling dedicated access arrangement. Usage rates are time-of-day and distance sensitive. Calls are billed in six second increments. A minimum average time requirement (MATR) of thirty seconds per call applies during a billing period.
(3) ExactCall Toll-Free - This service option is an inward calling termination arrangement available via shared and dedicated access facilities. Usage rates are time-of-day sensitive. Calls are billed in six second increments. A minimum average time requirement (MATR) of thirty seconds per call applies during a billing period.
(4) ExactCall Card - This service option is an outward calling shared access arrangement which, allows a customer to originate calls through use of a Company calling card via an Toll-Free Universal Access Number. Usage rates are time-of-day sensitive. Calls are billed in six second increments subject to a one minute per call minimum.
(5) ExactCall MTS - This service option is an outward calling shared access arrangement available to customers who presubscribe to the Company's service. Usage rates are time-of-day sensitive. 4.4 THE ANSWER FAMILY OF SERVICES
A) Description
"The Answer" is a family of service offerings that offers a unified service for single or multi-location customers using switched, dedicated, and OnLINE card origination and switched or dedicated toll-free (in WATS) termination. "The Answer" package includes the availability of switched and dedicated access termination with peak and off peak rates, volume discounts, accounting codes, call detail, and a consolidated invoice for all locations. All fractional per call charges will be rounded to the nearest whole cent.
"The Answer" I is available as an outgoing switched product with origination via FGD, equal access lines. "The Answer" II is available as an outgoing dedicated product via customer-provided dedicated access line (DAL) or T-1 access. "The Answer" III is an toll-free product via regular business lines. "The Answer" IV is an toll-free product via customer-provided dedicated access line (DAL) or T-1 service. "The Answer" V OnLine World Calling Card is available as a calling card service. "The Answer" IX and X are available for Associations under the Association Saver Program and offer a switched outbound service and switched toll-free service, respectively.
B) "The Answer" Extended Service Plan ("ESP")
"The Answer" services are available to customers through an Extended Service Plan ("ESP") option if the customer agrees to commit to such service for a term of twelve (12), twenty-four (24), or thirty-six (36) months and to generate a minimum monthly gross usage. Customers who elect the Answer ESP option are subject to the following:
(1) Customers must indicate what Answer service or services are to be included in the ESP. The discounts provided under this option become effective with the first full month's usage.
(2) Customers must reach the minimum usage requirement associated with each Answer ESP option by the fourth invoice period and monthly thereafter.
(3) Customers who do not generate the monthly minimum required in a given month will be billed the monthly minimum in lieu of the actual usage for that month. No discounts will be applied if usage does not reach required ESP option monthly minimum.
(4) Customers who terminate service prior to the end of the term of commitment will be billed the minimum usage requirement times the number of full or partial months remaining in the term in one lump sum. This charge will not apply to Company Answer customers who convert from an Answer service to another Company service with equal or greater term and minimum requirement commitments.
(5) All customer requests to commence or terminate an Answer ESP must be made in writing to the Company and received no later than the last day of the month preceding the month in which the desired action is to take effect. The customer must provide written notification to cancel the ESP which must be received by the Company not less than 30 days prior to the expiration of the term commitment. If such notification is not received by the Company within this timeframe, the Answer ESP agreement will be automatically renewed for a new term of commitment.
(6) Customers who elect ESP for "The Answer" I or III must meet the minimum usage requirement of $250 per month per account for each service. Customers who elect ESP for "The Answer" II or IV must meet the minimum usage requirement of $1,000 per month per account for each service. A minimum commitment does not apply to the "The Answer" V OnLine World Calling Card service.
(7) Customers who subscribe to "The Answer" through an ESP option will receive the ESP discounts in lieu of the standard discounts.
(8) This additional discount is applied to all peak domestic usage and is given only to customers who have met the monthly minimum usage requirement.
(9) Total intrastate, interstate and international usage contributes to discount level, including "The Answer V - OnLine World Calling Card usage. Directory Assistance calls are not added to the total of monthly usage to determine the appropriate discount nor are they discounted.
C) Association Saver
The Association Saver Program is a benefit package which, allows the individual users who are members or employees of the participating organization to receive additional product discounts. Members who elect to participate in the Association Saver program will receive Answer products and OnLine Calling Card Service.
To qualify for Association Saver an organization generally must be a: (1) Trade association representing businesses or individuals in an industry, profession or business classification; (2) Business with franchises, agents, distributors, or multiple representatives; (3) Non profit organization, or; (4) Buying group not organized merely to buy Company long distance for resale. The qualifying organization agrees to meet the following set of criteria within (6) months of undertaking to qualify and thereafter maintain them, and enters into a written agreement with the Company for the marketing of the Company's services. The group's members who have subscribed to the Company's services throughout the group must have aggregate billings, net of taxes; promotional credits and surcharges of at least $5,000 per month.
The Company will render monthly statements to the individual members and the statement received will show all appropriate discounts. All sums due from members are the sole property of the Company, and the Company shall have the sole right to collect, enforce collection and settle such sums. The Association Saver member group shall receive a monthly report from Company listing members of the group who subscribe to Company service under this program.
Unless otherwise specified in this tariff, member's usage of Company service under this plan cannot be used to qualify for any other benefits under this tariff or under other arrangements between the Company and third parties who undertake to market the Company's services.
Discounts Applicable to "The Answer" - Group members who subscribe to Answer I or III products (to include a twelve or twenty-four month "ESP" term commitment) will receive a five (5%) percent discount of Answer usage up to $2500.00. Group members who subscribe to Answer II or IV products will receive the following rates: (1) members who elect no term commitment will receive term rates applicable to a twelve-month "ESP" term commitment; (2) members who commit to a twelve-month "ESP" term will receive term rates applicable to a twenty-four month "ESP" term commitment; and (3) members who commit to a twenty-four month "ESP" term will receive term rates applicable to a thirty-six month "ESP" term commitment.
D) Interstate Usage Charges
(1) Rate Periods
Peak
All calls that occur between 7 A.M. through 7 P.M. Monday through Friday, except on Company-recognized holidays.
Off Peak
All calls that occur between 7:01 P.M. through 6:59 A.M. Monday through Thursday, and all calls between 7:01 P.M. Friday and 6:59 A.M. Monday and Company-recognized holidays.
(2) Billing Increments
"The Answer" products are billed in six (6) second initial increments and are rounded to the next higher six (6) second increment (except International, which is billed in thirty (30) second initial increments and is rounded to the next higher six (6) second increment). "The Answer" V OnLine World Calling Card usage is billed at an initial sixty (60) second increment and rounded to the next higher six (6) second increment thereafter. All fractional per call charges will be rounded to the nearest whole cent.
(3) Per Minute Rate Schedule
(a) "The Answer" I, II, III, IV, X and IX per minute rates for "The Answer" Services apply as shown below. In addition, a volume discount will apply to each month's total Peak usage as specified in Section (9) following.

(2) Per Call Surcharge
A per call surcharge of $2.50 will apply on calling card calls in addition to the rates following.
(3) Rate Discounts and Application Periods
The rate applicable at the start of chargeable time at the calling station applies to the entire call. That is, if a call is initiated during the Standard rate period and continues into the Discount rate period, the Standard rate applies to the initial 30 seconds and to all additional 6 second increments that the call continues.
(4) Rates Applicable on Certain Holidays
The Discount rate is applicable, unless a lower rate could normally apply, for calls on New Year's Day (January 1) and Christmas Day (December 25).
(5) Rate Schedule: The following rates apply to all available classes of service.
